Whereas: The real problem with Bill C-6 is that it can be extended to deprive citizens of due process in any area arbitrarily added to the schedules by the minister without taking it to parliament. It sets a precedence for denying due process that could be applied to any legal action against citizens; and Whereas: Due process is the only right of citizens that can not be suspended under Clause 33 of the Canadian Charter of Rights and Freedoms which can be used to take away any of the other rights if it can be shown to be for the good of the nation. Taking away due process can never be justified by Clause 33. If Bill C-6 passes, citizens of Canada will be subject to the whim of the government without legal recourse: Therefore: Be it resolved that the Canadian Action Party take a strong position opposing Bill C-6 and work to publicize and expose the implications of this invasive legislation possibly investigating a constitutional challenge. |
